 Twitter Inc., USA, a public corporation since Sept. 2013, has made spectacular financial growth, since its inception in April 2007. The 'promoted tweet' with its flagship earning tool, the corporation claims to be the promoter of Right to Free Speech and Protector of public health etc. as motto of the company. Today it has its presence in almost all the countries world over. In India, it has got status of an Internet Intermediary, under section 79 of the IT Act 2000. As a intermediary, a company should act a postman and not a tailor to distort or change the information or the contents posted by its user.  As a responsible intermediary Section 79 expect due diligence from them so that content which is against the law or having potential of inciting offence, cause defamation should be removed, though protection from liability is secured and guaranteed for intermediary in this section for posting of unlawful content by its user, using services  of Intermediary company. Baba Ramdeo vs IMA controversy

  Dispute between Baba Ramdeo and IMA is an untimely and unnecessary one. When India is battling against the pandemic like Covid-19, who said what? and Which therapy is better than the other ? is absolutely unwarranted. Even if Baba Ramdeo has said something about Allopathy, he quickly regrets and withdraws his statement after receiving a letter from Union Health Minister, Shri Harsh Vardhan ji. The entire controversy had to be stopped then and there but again he issued a letter against IMA and sought answers to 25 questions, over which IMA got fumed and issued legal notice to the Baba and threatened him of taking to the court in a 1000 crore defamation case.  All these developments seem immature and a reflection of lack of maturity from the people holding positions in big organisations, be it IMA and its president Dr. J A Jayalal or public influencer like Baba Ramdeo ji.  Moreover, when this is done in public domain, when people are badly suffering on health co...

Bengal Violence and Indian Federation

Bengal, one of the India's most prosperous state once, is in headlines for all the wrong reasons for last few months. Violence during voting for State assembly elections, low level of politics and political discourse by state leadership and utter disregard for constitutional federalism, is what Bengal is known for in last few months.  This has not only brought bad name for the state bur had set bad precedents for other states also.  This all begin with political opposition and protest against Demonetization, organizing Dharnas by sitting state CM in front of RBI, then stopping central investigation agency CBI from investigation against a top level police officer in state, immediately the trend was picked up by other states. This blot on federal structure of India didn't stop there, it was also perpetuated in state assembly elections. Even Prime Minister of India was called an outsider without any remorse. LOCK-DOWN, COVID-19 AND LAW

A law cannot cure a disease but certainly it can be helpful in arresting spread of a disease. Amid the outbreak of an epidemic Covid-19 world is facing a public health emergency of an unprecedented order. One after another state is declaring lockdown, people are living in the shadow of fear, fear of an untimely disgraceful death. The countries which are most affected till date after China are Italy, Iran, Spain, USA   and many more, including India. This extraordinary situation is calling for extraordinary measures and in India drastic measures are being taken in last couple of weeks. Some by central government while many by respective state governments and local bodies.
